Terms & Conditions
Please read these Terms & Conditions (“T&C”) carefully. The following is a legal agreement between you (“purchaser”) and the owner of Laugh & Grow Press (“L&G”), which governs your use of all items purchased from L&G. Products referred to within the T&C apply to any items purchased or downloaded from L&G.
By making this purchase, you agree to be bound by the T&C of this Agreement automatically, without any other conditions or declarations. If you do not agree with these terms, you are not allowed to make this purchase.
COPYRIGHT
All products, designs, and design elements are protected under United States and International Copyright Laws and are not to be distributed, resold, shared, or copied in any form. L&G takes the protection of our copyrights very seriously and if L&G discovers that you have used its copyright materials in a manner that violates the T&C, L&G may bring legal proceedings against you seeking monetary damages and an injunction to stop using those materials. In addition, you could also be ordered to pay our legal costs.
LICENSE
You acknowledge that by your purchase, the ownership of the product(s) does not transfer to you and you may not claim that it is yours. Your license is non-transferable, which means that you are not allowed to sell, distribute, rent, give, sub-license, or otherwise transfer the product(s) or the right to use the products(s), in whole or in part, to anyone else. Ownership is retained by the L&G.
PRE-MADE LOGOS
These products are not immediate downloadable files, they will be customized by L&G to your business name of choice, and then delivered to you via email after finalization. Once payment and ordering information is received, a proof of your logo will be sent to your email. Please, allow up to 48 hours for delivery of files.
PHOTOS
Photos are not included with purchase. Some files include print bleeds and can be adjusted as needed per your print lab specs.
INSTALLATION AND USAGE
The product may be installed on all computers directly owned by the purchaser of the product. By purchasing the product(s), you agree to NOT resell or redistribute these products to others (i.e. friends, co-workers, photographers, relatives, etc.) or install the products on computers not owned by the purchaser. You also agree to not save, download or install the product(s) on any computer not owned by the purchaser.
L&G products are required to be used by professional photographers or for personal use only. The work you create with the product(s) must be used personally or professionally. For example, professional photographers can purchase L&G products for use in their business as products to offer their clients in flattened digital files or printed files, and not in the original PSD file form. Layered files using L&G products may not be resold or distributed to your client. L&G products and are not permitted to be used in logos, websites, blogs, and/or other branding and marketing materials. If you are uncertain about permitted use, please contact us at kim@laughandgrow.com and inquire.
You may modify the product(s) should the need arise but modifications do not expand the license to include ownership and copyright. All ownership and copyright are retained by L&G.
You may not modify or superficially alter the product(s) and then resell them as your own. You may NOT look at the components (e.g. layers, brushes, design elements, etc.) that make up the products and then use L&G’s concepts in your own product for resale or distribution of any kind. For example, you may not purchase a Photoshop template, modify it, and then resell the modified template.
You may NOT redistribute or resell the product(s) in whole or in part. You may not place any of L&G products, modified or unmodified, on a diskette, CD, website, forums or any other medium and offer them for redistribution or resale in a fashion that would violate this license. This strictly prohibits uploading/sharing on forums, emails or other where someone other than the purchaser can view, download or copy files.
Font information will be provided.
L&G is not responsible for errors printed products. Although we do our best to check for errors, it is your responsibility to double check all guides, bleeds, trim lines, colors, and text before printing.
RESPONSIBILITY OF PURCHASER
If you are not redirected to L&G website after completing your payment in PayPal, rest assured that you will receive an email with your download links after payment has been received and processed. If you do not receive the email, please check your spam/junk folder.Download links are viable for 48 hours after purchase. It is the responsibility of the purchaser to download the product(s) immediately and securely back up all purchases. L&G is not liable for any loss or damage to products after download.
RETURN POLICY
You acknowledge that all L&G products are non-refundable and not returnable, under any circumstances. All sales are final. Prior to purchase, please make sure you select the proper version of Photoshop CS or Photoshop Elements (“Elements”). Products sold at L&G do not include the software to run them. Products purchased are not returnable or exchangeable due to difficulty level of using or not having the proper software to run them (e.g., if you buy a product that only works in the “Full” Photoshop CS version and you only have Elements, L&G will not refund you. Products are tested in English versions of Photoshop only. They may not work in Photoshop in other languages. Please do not purchase if you are not willing to take the risk.
DISCOUNTS
Only one discount code may be used per order. When using a discount code, place all items in the cart first, then apply the discount code. Discounts are NOT retro-active.
UPGRADE POLICY
While most products are forward compatible with future Adobe products, some are not. We do not guarantee our product(s) will be compatible in future versions of Photoshop or Elements. Additionally, product(s) for Photoshop and Elements are not the same. If you switch from Elements to Photoshop, we offer a 50% discount on products you purchased for Elements and want for Photoshop. It is your responsibility to keep proof of purchase to upgrade to the Photoshop version.
DISCLAIMER
L&G creates and sells add-on files which are compatible with Adobe® products such as Photoshop®, and Elements®. The files sold by L&G are not made by or for Adobe®. L&G is not a partner of Adobe®. L&G is not associated in any way to the above mentioned companies and or their respective product’s.
DISCLAIMER OF WARRANTIES AND LIABILITIES
PRODUCTS ARE PROVIDED “AS IS”. L&G OFFERS NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY PRODUCT, THE ACCURACY OF ANY INFORMATION, OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
L&G DOES NOT REPRESENT OR WARRANT THAT THE PRODUCT(S) WILL MEET YOUR REQUIREMENTS OR THAT THEIR — USE WILL BE UNINTERRUPTED OR ERROR FREE.
L&G SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR — USE OF THE PRODUCT(S).
